Günümüzde artan rekabet, maliyetler ve tüketici tatminsizliği vb. gibi sebeplerin sağlık alanında faaliyet gösteren firmaları, varlıklarını sürdürebilmeleri için yeniliklere zorladığı söylenebilir. Sağlık alanında yenilik denildiğinde akla ilk gelen sektör ilaç sektörüdür. Örneğin, 2012 yılı araştırma geliştirme yoğunluğuna göre sektörlerin sıralanmasında ilaç ve biyoteknoloji sektörü ilk sırada yer almaktadır. Yeni geliştirilen bir etken maddeye sahip ilaca orijinal ilaç denmektedir ve orijinal ilaçlar patent korumasından faydalanabilmektedir. Patent koruması, mevzuat gereği buluş sahibi firmaya 20 yıl süreyle pazarda tekel olma hakkı tanımaktadır. Ancak, yeni keşfedilen etken maddenin patentinin alınması ile söz konusu etken maddeden üretilen ilacın piyasaya çıkma süresi arasında 10 yıldan fazla bir zaman geçmektedir. Bu durumun ilaç firmalarını olumsuz etkilemesini önlemek için, Avrupa Birliği ülkelerinde Ek Koruma Sertifikası uygulanmaya başlamıştır. Bu çalışmanın amacı ilaç sektöründe ürün geliştirme ve Ek Koruma Sertifikası konusunu tartışmak; Türkiye ilaç sektörünü bu bakış açısıyla ve genel hatlarıyla incelemektir.
Nowadays, companies operating in the field of health said forced that the innovation to sustain their existence due to reasons as increasing competition, costs and consumer satisfaction etc. Pharmaceutical industry is the first sector that comes to mind for innovation in the health field. For example, according to the intensity of research and development in 2012, the first place is pharmaceutical and biotechnology sector in sector of the rankings. Original drug is called that a newly developed drugs having an active substance and original drugs may benefit from patent protection. Patent protection, the inventor of the regulations gives to the company the right to a monopoly for 20 years in the market. However more than 10 years time passes between upon receipt of patent that the newly discovered active ingredient and the time to market drug that produced from active substance. To avoid adversely affecting the pharmaceutical companies of this situation has started to be implemented a Supplementary Protection Certificate in European Union countries. The aim of this study is discuss product development and Supplementary Protection Certificate in the pharmaceutical sector; Turkey pharmaceutical industry examine with this perspective and in general terms.
